The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

On April 13, 2023, the following charges were brought againts Justin Kiswardy, owner of Window Select, LLC. 

Theft-False Representation>$5000-$10,0000 - Felony 

A pre-trial conference has been scheduled for August 1, 2024.

Pattern of Complaints

On February 19th, 2021, a Pattern of Complaints was detected for Window Select. The complaints in this pattern pertained to consumers stating they paid for installation of windows/doors, and these services are not being completed, being partially completed, and/or being installed improperly. Consumers also stated the business does not consistently respond to their attempts to reach out to them for assistance.  

On March 19th, 2021, the BBB received a response from Window Select addressing the issues presented in the pattern of complaints. A portion of their response is below:

Window Select is focused on providing the highest level of customer service. In the previous twelve months, 02/2020 - 02/2021, the company enjoyed incredible growth of more than 2,200 new customers, despite significant supply-chain challenges caused by the global pandemic. Window Select is doing everything in its power to keep its customers informed about progress and to deliver the highest-quality American-made windows, siding, and doors as quickly as possible.

Window Select regrets that it did not meet the customer service expectations of less than 0.5% of its customers in the last year. The company is dedicated to exceeding its customers' expectation and will continue to train and develop all of its associates to ensure this goal is achieved.

On July 8th, 2021. BBB sent a second letter to Window Select regarding an additional pattern noted in their complaints. This pattern pertains to consumers that financed funds through a third-party finance company. Complainants report that Window Select had asked them to sign documents confirming that work had been completedwhen in some caseswork had not started. This was apparently done so that the funds could be released to Window Select.  Some complainants state that they have been making payments to the finance company for projects that have not started, or in some cases, don't have a confirmed start date. In addition, complainants have also stated that funds may have been released without their knowledge from the finance company and paid directly to Window Select. 

On September 1st, 2021, the BBB received a response from Window Select addressing the issues that were presented in this second pattern of complaints. A portion of their response is below:

The independent third-party financer is not related to Window Select in any way. Mr. Kiswardy decided to do business with this financer based solely upon his positive history with that company at his former business. Window Select's customers may pay cash or finance their purchase, and if they finance, Window Select does not require them to use this business. If customers choose to use this business (or any other company) for financing, they enter into a separate contract with the financer. Window Select is not a party to that agreement. Window Select is unable to provide information about communications between this business and those for whom it provides financing. But based upon years of experience with the company, Window Select believes that the financer's actions comport fully with the terms of its agreements and all applicable laws and regulations. If the BBB has concerns about the specifics of this business's financing, Window Select is unable to address those concerns, as they are a separate legal entity.

On 02/17/2023, the business filed for reorganization under Chapter 11 of the federal Bankruptcy Act, case# 23-20646-gmh. This permits the business to continue to operate with court supervision while developing a plan of reorganization. Those with monetary claims against the business are advised to obtain a Proof of Claim form by writing to US Bankruptcy Cout Eastern District of Wisconsin 517 E Wisconsin Ave Milwaukee WI 53202 for resubmission to that court. The case number should be entered on the form. Claims must be submitted by 02/17/2023
