    Construction of VA was first
    brought to the attention of the Better Business Bureau on November 30, 2020. During
    a Better Business Bureau investigation of Smart Moves Construction
    doing business as Turtle Rock Construction of VA did not have a 2022
    business license according to the Virginia Beach, Virginia Commissioner of
    Revenue. Smart Moves Construction doing business as Turtle Rock Construction of VA has
    been marked as inactive with the Virginia State Corporation Commission. An
    Internet search of the company, principal, and address revealed no adverse
    information on the company however there were mixed reviews regarding one of
    the principals. A viral search of the address on file with the BBB was revealed
    to be a commercial building. The company has had no reports posted to the BBB’s
    ScamTracker page: https://www.bbb.org/scamtracker/us.

    On
    August 25, 2021, an investigation letter was sent to the company by the BBB
    regarding their revoked contractor’s license.  On October 28, 2022, mail sent to the company was returned by the post
    office as “Return to Sender, Not Deliverable as Addressed, Unable to Forward.” As
    of the date of this Business Profile, the operating status of the company is
    undetermined.

  • According to the Virginia Department of Professional and Occupational Regulation (DPOR) website Smart Moves Construction doing business as Turtle Rock Construction of VA has two Consent Orders on file entered on May 10, 2022 citing the following violations:

    -Failure of those engage in residential contracting, to comply with the terms of a written contract that contains the following minimum requirements;
    A “plain-language” exculpatory clause concerning events beyond the control of the contractor and a statement explaining that delays caused by such events do not constitute abandonment and are not included in calculating timeframes for payment or performance,
    A Statement of assurance that the contractor will comply with all local requirements for building permits, inspections, and zoning,
    Contractor’ name, address, license number, class of license, and classification or specialty services,
    Statement providing that any modifications to the contract, which changes the cost, materials, work to be performed, or estimated completion date, must be in writing and signed by all parties, and
    Effective with all new contracts entered into after July 1, 2015, a statement notifying consumers of the existence of the Virginia Contractor Transaction Recovery Fund that includes information on how to contact the board for claim information,
    -Practicing in a classification, specialty service, or class of license for which the contractor is not licensed,
    -Failure to obtain written change orders, which are signed by both the consumer and the licensee or his agent, to an already existing contract,
    -The intentional and unjustified failure to complete work contracted for or to comply with the terms in the contract,
    -Failure to satisfy any judgments,
    -Failure of a contractor to comply with the notification requirements of the Virginia Underground Utility Damage Prevention Act,
    -Refusing or failing, upon request, to product to the board, or any of its agents, any document, book, record, or a copy of it in the licensee’s possession concerning a transaction which the licensee is required to maintain records, and
    -Any change of address of record or principal place of business shall be reported in writing to the board within 30 days of the change. The board shall not be responsible for the licensee’s failure to receive notices or correspondence due to the licensee’s not having reported a change of address.

    Smart Moves Construction doing business as Turtle Rock Construction of VA had their contractor’s license revoked, was fined a total of $7,150.00 by DPOR, must have a member of member of Responsible Management successfully complete a Board approved remedial education class within ninety (90) days and had ninety (90) days to pay fines along with revocation of license.
