       I reject Jakes Mobile Mix LLCs response to my complaint.


      To date:
      **** has never spoken directly to me.
      Jakes only communication came through *** A in the company office.
      In that singular conversation with *** A, he offered Free concrete plus $200 as restitution. 
      The concrete cost for my job, per my contractor, was $457.92. 
      *** A had quoted me about $600 in our singular conversation. 
      **** would later claim, in response to my BBB complaint, that the cost was $985.

      My previous offer of a peaceful settlement had been ignored.

      Jakes driver vandalized* my property. 
      He used his own loppers to cut structural, fruit-bearing branches from one tree. From the other tree, his truck tore structural, fruit-bearing branches off the tree, ripping the bark for about a foot down the branch from the wound in the process. Causing permanent damage to both trees.
      I filed a report of Vandalism with the ***************************  PPD Case #**-117751.

       I am a 75 year old avid gardener with a heart condition. The trauma of vandalism to my Asian Pear trees, plus the anxiety of dealing with ****, left me no option but to sue for damages.

      **** Bec, of Jakes Mobile ******** was served papers on 5-19-20**, informing him that I am taking his company to Small Claims Court in order to receive restitution.

      *Vandalism is legally defined as willful destruction of personal property not your own, and without the permission of the owner.

      We attempted to resolve this issue with the customer. Yes ,Unfortunately, due to safety concerns, the driver had to remove a few branches.We acknowledge that this was not handled in the ideal way.
      As a gesture of goodwill, we provided the concrete free of charge and offered an additional $200 compensation. While we understand his demand for a $2,000 refund, we were unable to accommodate that amount.
      He demanded a payment of $2,000, we did not agree with the evaluation of that amount. I have attached a text message thread with his phone number showing his demand of this amount and also his threat of the $200 check would be a insultthat  i was willing to mail, and how it would be insult and only further frustration.  Due to the branches that were broke, (not the entire trees) We did the entire job free of cost which totaled to $985.00
      I can also send proof of the concrete that was poured and given free at charge from us, if requested, please just let me know.
