      Unconscionable and oppressive contract, there was no disclosure prior to entering a contract of exorbitant termination fees. We have filed a complaint with the bank, the *** and will likely turn to small claims or further if needed. Our daughter was injured during a class, and its clear the instructors are both not trained in any sort of medical awareness or understanding. My daughter fell back, hit her head, bit her tongue hard enough to make it bleed and the instructor said drink some water and come back to practice.This was after another class that my daughter came back with two large inexplicable bruises on the tops of her knees, where the instructor acted in the same manner.This place is a disgrace and unsafe for children, but that's not all. When I texted the instructor that my daughter was wanting to quit because of this, I received no response, until the next day I received a bank alert that $1065 had been charged to my account by this despicable gym. I got an email a little later with fluff language explaining "fees are no fun," to which I cited **** and *** law stating that fees need to be disclosed and highlighted prior to signing a contract. I continued to explain to them how not disclosing such insane fees is highly deceptive and needed to have been done prior to signing a contract so we had a choice.This was met with more fluff language and an obvious misunderstanding of commerce law. Beware of this gym, they have a history of similar complaints with the Attorney General as well.

      Thank you for sharing your concerns. We take all feedback seriously and strive to maintain transparency and a safe environment for all our athletes. I'd like to thoroughly address each point in your complaint, providing details based on our records.
      **1. Incident on August 27th During Practice:**
      Your daughter, ****, bit her tongue during stunting practice on August 27th. She was working with Coach ******* on a new stunt, which none of the athletes had tried before. Her flyer accidentally bumped into her, leading to **** biting her tongue. There was no fall or head injury.
      Coach *******, who is certified in CPR and First Aid, assessed the situation immediately. She confirmed there was no visible blood and that **** did not hit her head. **** expressed frustration with the stunt's progress, and Coach ******* encouraged her to take a moment to get a drink of water. After a brief chat, **** chose to continue practicing and appeared to be doing well.
      Later that evening, at 7:23 PM, Coach ******* and Coach *** had a phone call with ******** (her mother) to discuss ****'s experience. We reassured her that **** was working hard on a challenging new stunt and that bumps and minor incidents are part of the learning process in cheerleading. During this call, you expressed that **** was enjoying her time at Thunder Elite and that she had grown more confident since joining.
      **2. Bruising on ***********:**
      Regarding the bruises on ***** knees from a previous practice, Id like to clarify that these were rug ***** resulting from a game the children played during practice. The kids were pretending to be dogs, crawling around on the floor. This playful activity was something the kids initiated and was not part of the normal practice curriculum. Coach **** then spoke with ******** on the phone to explain the situation, at which point she was very understanding and glad that we had time to connect. She also reiterated that **** was having so much fun, and they were happy she found a gym like ours.  I hope this clarifies that it was a minor incident unrelated to structured practice.
      **3. Communication Regarding ****************:**
      On September 3rd, we received a message from ***** father stating that she would be withdrawing from cheerleading due to school commitments. We promptly acknowledged this decision and, per the terms of the contract, issued an email the following day confirming the withdrawal and notifying you of the $1,000 early termination fee.
      We would like to emphasize that the termination fee is clearly outlined in the contract. According to our records, the contract was made available to you for review on May 5, 2024, at 12:29:24 UTC-7. This provided ample time for review before you signed and submitted the contract on May 12, 2024, at 09:09:27 UTC-7. Additionally, prior to tryouts, we held a livestreamed parent meeting where we answered all questions regarding the contract. During this meeting, we specifically highlighted the importance of reading through the contract thoroughly, as it represents a year-long commitment, and quitting could be expensive. The recording of this meeting remains available online for reference.
      **4. Clarification of Charges:**
      Following the notification of withdrawal, an additional $65 was charged to your account, which is unrelated to the termination fee. This amount was for a recent purchase from our pro shop. We understand that no one enjoys paying fees, but we believe we have been transparent regarding all charges and their justification as outlined in the signed contract. We also provided a copy of the contract in response to your request.
      **5. Safety and Instructor Training:**
      We take the safety of our athletes seriously. All of our coaches, including Coach *******, are CPR and First Aid certified and are trained to handle minor injuries and assess situations. ***** injury was minor, and Coach ******* followed appropriate protocol by assessing the situation, offering support, and monitoring ****'s condition before she returned to practice.
      **Conclusion:**
      We regret that your experience with Thunder Elite did not meet your expectations, and we have taken your feedback into consideration. Our goal is to create a positive, safe environment for all athletes, and we sincerely hope that despite this issue, **** had a fulfilling experience during her time with us.       If I could give this a zero star rating I would. Do not send your kids to this gym. They do not care about their athletes unless they are on the elite team. Their communication is terrible and coaches are mean to the kids. The director of fun does not handle issues with parents. If you give any feedback your kiddo gets kicked off the team.
