    BBB sent correspondence to SkyHyFlights on May 19, May 24, and May 31, 2023, requesting substantiation for advertised claims on their website. To date, the business has not responded to our request.

    On the website, BBB was unable to book any flights. It always shows LAX to Miami no matter what departing from and going to locations and dates were put in, and states there are no flights available.

    BBB asked what airlines SkyHyFlights is affiliated with?

    “PRICE MATCH PROMISE” BBB requested that the terms and conditions of the price match guarantee be disclosed in a clear and conspicuous location.
    “Track down our generally insignificant expense for complaints all over the planet, guaranteed.”
    BBB requested more information as to what this statement means.

    The following disclaimer appears in the footer of all pages on the website:
    "Disclaimer- There are no booking costs on the website. 
    BBB asked, “Why are there no booking costs on the website?” 
    Both prices shown are subject to change and can be deleted or changed at any time without warning. 
    BBB asked, “What is meant by both prices?” 
    Prices are only guaranteed until the full cost of the booking has been billed. 
    BBB advised, “This sentence contradicts the one to follow. It appears that the price is only guaranteed once it has been paid in full by the customer, not once it has been billed.” 
    Providing a deposit does not guarantee that the sum listed will be paid. A deposit assures your booking/session, but the quoted rates can be changed if you do not get the right payout before the payment date. 
    BBB asked, “Why is a deposit requested if it does not ensure that the price quoted for that deposit will not be honored?” 
    Both air fares and services (as well as all online bookings) must be charged in full at the time of reservation. Please refer to the most recent Terms & Conditions on the kit's website for information on any extra charges that might apply. 
    BBB asked, “Where are the kit’s terms and conditions? There is a link for terms and services, but no mention of extra charges. Only fees and payments and stating that the consumer is required to pay them. There is no explanation as to what any extra charges might be.”

    BBB asked, “Why must arbitration be held in Georgia?”

    Cancellation Policy states:
    “Cancellation of your trip will still include charges. Depending on the terms of the plane fare, you may or may not have the right to obtain a (partial) refund. You can read these conditions on your booking request slip under the heading: ‘View Ticket Conditions’”
    BBB asked. “What are the charges that will still apply if a request to cancel is made?”
    BBB requested an example of the booking request slip along with ticket conditions.

    Refund Policy states:
    “The convenience fee charged at the time of booking is a non-refundable fee that is applied on all cancellations, including all partial cancellation requests.”
    BBB asked, “How much is the convenience fee? Is it a standard fee that applies to all purchases? Where in the advertising does it advise of a convenience fee and how much it is?”
    What is a partial cancellation request?

    “In the event that the customer cancels his / her booking directly with the airlines, he / she would need to inform the Organization with valid paperwork to begin the refund process. It is recommended to notify the Organization within 48 hours of the cancellation order.”
    BBB asked, “Who is the “Organization”? If it is SkyHyFlights, why would you be providing the refund? Isn’t the ticket issued in the customer’s name and payment made to the airline for the ticket? Wouldn’t the airline have the customers money to refund them?”

    “The Company will be able to activate the refund of the customer only after receipt and/or acknowledgment of the refund by the airline.”
    BBB asked, “Who is “the company”? Please provide more information as to what this statement means. Who is receiving the refund from the airline? If it is the customer, what refund is “the company” activating?”

    BBB Code of Advertising:
    1. Basic Principles of the Code
    1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
    1.2 Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used.
    1.3 An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true.
    1.4 Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact.

    12. Lowest prices, underselling claims
    Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of unqualified underselling/lowest price claims.
    12.1 Advertisers must have proper substantiation for all claims prior to dissemination.
    12.2 Unqualified underselling claims must be avoided.
    12.3 Advertisers can lessen the potential for consumer confusion by appropriate qualifications to any underselling/lowest price claim, such as by stating, if truthful, that the advertiser will meet or beat a lower price. In such circumstances, the advertiser must comply with Section 13.

    13. Price equaling, meeting competitors’ prices
    13.1 Advertisements which set out company policy of matching or bettering competitors' prices may be used, provided that:
    13.1.1 The offer is made in good faith;
    13.1.2 The offer clearly and conspicuously discloses fully any material and significant conditions which apply including, if applicable, what evidence a consumer must present to take advantage of the offer; and
    13.1.3 The terms of the offer are not unrealistic or unreasonable for the consumer.
    13.2 Advertisers should be aware that such claims, unless appropriately qualified, may create an implicit obligation to adjust prices generally for specific products or services. This may be the case where the advertiser's price for a product or service is not as low as or lower than a competitor's price.

    17. Extra Charges
    Whenever an advertiser mentions a price in advertising, the existence of any unavoidable or extra charges must be clearly and conspicuously disclosed in immediate conjunction with the price. This would include, for example, charges for delivery, installation, assembly, excise tax and postage and handling.
