Quick and to the point. Contacted by LGE for a job in the area. Job details was presented both in print and orally. We told LGE we would not accept 60 days net payment terms. We submitted our estimate/ invoice that clearly detailed payment would be 30 days net to include definitions of receipt of payment and or terms of late fees. We were then contacted again after LGE received our estimate and was asked if we could come down on our price any. We stated no and soon after we were notified that LGE had authorized our company to proceed with the work. Work was completed on time and as specified. The local business manager signed off on the work on the form supplied by LGE. On this form was the notation of their terms of 60 days net payment. We scratched through the 60 days and wrote 30 days. We also noted the original estimate contained our terms. 30 Days passed and no payment. In an attempt to keep their late fees from adding up we sent them an email advising them of our terms. The response was our check was scheduled to be issued at the 60 day net payment terms. We sent a response through email stating the terms they agreed to were 30 days and late fees had started to be assessed. We made a phone call and spoke with one agent who stated we agreed to their terms of 60 days net by not completing their vendor packet. Of course the counter to that was how could we agree to anything if nothing was submitted agreeing to those terms. The follow up was LGE agreed to our terms of 30 days net and the late fees when they authorized the work after receiving and reviewing our estimate. LGE did send a check for "partial" payment which was received before their 60 day net but weeks after the 30 day net period. There is still the outstanding balance due.Read their terms and conditions. If you don't agree with them do not sign them and send them yours. As you have the option not to accept theirs, they have the option not to accept yours.
