    My wife and I have used R & S Pool and Spa Services (hereafter ****** for the past 8 years for all of our pool needs, including the opening and closing of our pool each year. This past ***** was a scheduled home visit by ***** to open our pool for the 2022 season. The water temperature the day they were here was 54 degrees. We have a vinyl pool and when vinyl is cold it is not pliable and subject to cracking if something strikes it. One of the tasks ***** service technicians perform during the opening of a pool is to vacuum the sediment from the bottom of the pool that has accumulated over the winter months. The technician was well aware of the water temperature but proceeded to vacuum the pool anyway. I assumed (since hes the professional) that he understood the potential dangers of vacuuming a vinyl pool with the water temperature as low as it was and therefore he would take the necessary precautions to avoid striking and potentially damaging the liner. When they left, everything appeared to be fine.The following morning the water level in the pool had dropped by 15 inches, which almost certainly means a leak somewhere. I looked and spotted a crack in the pool liner which most certainly could have only been caused by the technicians negligence during the vacuuming process.The next day I reached out to ***** and asked for the name of their liability insurance company. I was told they assume NO responsibility for any damages caused to our pool liner and would not divulge the name of the insurance company or if they even carry liability insurance.We took ***** to small claims court but lost the judgment to have them pay for a new liner plus installation costs even after ***** admitted in court that their technician had damaged the liner so as to render it not repairable. What follows in the my next review is the transcript of the Judges ruling:
