  Government Action: BBB reports on known government actions involving business’ marketplace conduct:

  Minnesota Dept. of Labor & Industry Consent Order
  

  On April 13, 2022, the business entered into a Consent Order with the Minnesota Department of Labor & Industry (DLI). The Consent Order settles allegations that the business demonstrated financial irresponsibility by failing to satisfy a civil judgement from November, 2021, a violation of Minn. Stat. 326B.082, subd. 11(b)(9) and 326B.84 (15) (2020); transacted business in a name other than their licensed name, a violation of Minn. Stat. 326B.082, subd. 11(b)(8) and 326B.84 (2) (2020) and Minn.R. 2891.0040, subp. 1E (2021). The business also failed to notify DLI of their change in address, a violation of Minn. Stat. 326B.805, subd.5(a) (2020).  Under terms of the Consent Order, the business agreed to suspension of the licenses for Endurance Excavation & Building, formerly known as Jericho Construction and for the qualifying builder license for Nicholas Esparza until they demonstrate to DLI that they have satisfied all civil judgements and reimbursed DLI's Contractor Recovery Fund; and will not act as or claim to be a residential builder, contractor, remodeler or residential roofer in Minnesota until the suspension is ended. The Consent Order allows the business to act as a subcontractor for interior finishing services, as defined in Minn. Stat. 326B.802, subd. 15(d) (2020). The business also agreed to pay $1500 of a $6500 penalty to DLI.  The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
