- Government Actions:Government Action: BBB reports on known government actions involving business’ marketplace conduct:Minnesota Department of Commerce Consent Order
On October 9,2023, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business's title insurance license was inactive from October 31, 2011 until June 4, 2015 and did not renew its title insurance license in October 2020. In addition, on December 8, 2015, they entered into an agreement to issue title insurance polices in Minnesota while they were not licensed until September 7, 2021, when they became licensed. This is a violation of Minn. Stat. § 60K.32. Also, the Order alleges the business owner, Mr. Person provided incorrect, misleading, incomplete and 'materially untrue' information to Minnesota Dept. of Commerce during their investigation, a violation of Minn. Stat. § 60K.43, subd, 1(1) and Minn. Stat. § 45.027, subd. 7(a)(3). In addition, the business website advertising included references to an unauthorized doing-business-as name, a violation of Minn. Stat. 4 60K.41; the dba name was the name of the business licensed in June 2015 to October 2020, which was misleading to consumers and Minnesota Dept. of Commerce about the identity of the business, a violation of Minn. Stat. §§ 60K.43, subd. 1(8) and 45.027, subd. 7(a)(3).
Under terms of the Consent Order, the business agreed to pay a civil penalty of $5,000.00; the Insurance Producer license is suspended for 60 days during which time, the business must either appoint a different designated person as an Insurance Producer or cease and desist from selling insurance. The business also agreed to cease and desist from future violations of any laws, rules or orders under the authority of Minnesota Department of Commerce and to pay investigation costs of $337.50.
