My mother resided at ALW on the Magothy, on Mountain Road for 2 years. They advertise a chef that cooks 3 meals per day and lots of activities. It turns out they had a cook at another facility in Millersville, that cooked only 2 meals, lunch and dinner there, and drove it to Mountain Road. The food was typically over cooked or cold and not good.
There is no activities director but they did have coloring books and paint that the residents could do by themselves.
Mom and her 4 children unanimously agreed she should relocate. Proper notice of our intent to vacate on 11/16/24 was given.
I, as her POA had her monthly rent payments of $7,000 on auto pay to deliver the 1st of each month. Her prorated rent for Nov, 2024 was correctly invoiced by owners at $3,500. I was out of the country and forgot to adjust the Nov rent down to $3,500. I texted the owners on Nov 12 regarding the overpayment. After numerous phone calls and texts pleading for him to do the right thing. The owner finally responded Dec 19 via text saying "Year end Will get it". It never came.
The Dept of Aging suggested we contact the State Attorney, Office of Consumer Protection (CPD) to mediate the complaint. I did so January 15, 2025. On Jan 27 a letter from CPD was sent to the owners who would called the CPD but put nothing in writing, as required. A second letter from CPD was sent advising the owners had until Feb 27, 2025 to provide a written response.
CPD sent a letter dated Feb 28, 2025 regretting to advise us that the owners failed to cooperate and this matter will not be resolved through mediation. It suggested that we file suit in the District Court (DC) Small Claims.
DC Attorney help desk advised me my 89 year old mother must call and come to courthouse to speak for herself. I drove her there and on Mar 4, DC sent a certified letter to the owners of Notice of mom's suit. Are these compassionate senior care owner/operators? I think not! Withholding my mother's hard earned money.
