- Fails to address and/or perform maintenance requests in a timely manner

On September 9, 2022, BBB requested that the business respond to alleged pattern. On September 16, 2022, the business responded to BBB and outlined steps they plan to implement to eliminate the alleged pattern of complaint. Their steps include the following:
· Putting several checks and balances into place to ensure they are more communicative with tenants
· Changing how they bill for move out charges and how the final disposition looks to make it easier for tenants to understand charges.
· Implementing a new dispute process for when tenants receive final dispositions to make sure Middle Town Property Group responds in a timely manner if any adjustments have been made or denied.
· Using vendors along with their on-staff maintenance department in order to dispatch multiple vendors throughout the day to complete work orders faster and more reliably, including work orders that are considered less urgent.
As of September 19, 2022, BBB will continue to monitor the alleged pattern.

Government Actions
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On August 28, 2023, Middle Town Property Group entered an Assurance of Voluntary Compliance with the Office of the Attorney General. The Assurance settles allegations that the business violated Indiana’s Deceptive Consumer Sales Act and the Indiana Home Loan Practices Act. Under the terms of the Assurance, the business agreed to follow through with the following actions:
- cease the use of the BSU Rentals unregistered trade name on all marketing materials;
- make affirmative changes to all current and future residential leases requiring reasonable notice prior to entry of leased units by these companies or their agents;
- cease the use of a “redecoration fee,” which had the effect of charging tenants for a preexisting legal duty to deliver leased units in a safe, clean and livable condition;
- remove “as-is” language from all the companies’ leases and agree to abide by the landlord obligations found in Ind. Code § 32-31-8-5; and
- participate in compliance monitoring requiring the companies to issue quarterly reports to the Homeowner Protection Unit for a compliance period of two years running from Sept. 1, 2023 to June 1, 2025.
