    I went to Dr. ********************** for cataract surgery and Dr. ********************** recommended I pay for the $3,700 premium care package for a premium Toric IOL lens in my left eye, to have close up vision and to correct an astigmatism. This charge was paid entirely at my own expense, on top of the basic surgery charge which would be paid by my medical insurance.The surgery on my left eye was performed on June 3rd 2024 with complication. Dr. ********************** left big pieces of cataract fragments in my eye. A Vitrectomy surgery with Dr. ********* at ************************* was required on July 17th 2024 to regain my eye sight.Later, I was informed by *********************** for a refund, due to the fact that doctor ********************** did not put a Toric IOL lens in my left eye, instead he inserted a standard PIECE lens, which does not correct astigmatism!The fact that Dr. ********************** did not inform me of this is highly unprofessional and should be considered as medical fraud. Upon confrontation, Dr. ********************** only offered me reimbursement of a fraction of the $3,700 I paid for the premium Toric IOL lens conditioned on me signing a release for all claims which I did not accept. I am requesting that Dr. ********************** reimburse me the $3,700 for the Toric IOL lens I did not receive. Dr. ********************** told me that he had to pay the clinic where the surgery was held a fee for using surgery equipment related to the Toric IOL lens. If Dr. ********************** paid some of the $3,700 monies I gave him to the clinic that he was not reimbursed for non-use, then I would like him to produce receipts showing that the payment was made to the clinic and that it was not reimbursable if not used. Lastly, I should not have to sign a release of all claims for Dr. ********************** to reimburse me for an overpayment of monies to him related to the Toric IOL lens. I am asking the Better Business Bureau for help in getting Dr. ********************** to reimburse me for an overpayment of monies to him related to the Toric IOL lens which I did not receive.
