On April 13, 2023, BBB requested Alaya&Co Inc to modify, substantiate, or discontinue claims made on their website (https://www.alayaandco.com/) that read, "We have a unique formula that delivers a response rate five times that of direct mail in the market.", "*Our staff individually hand addresses each and every envelope to ensure a 100% open rate (five times that of traditional direct mail)", "-Strong traffic due to a 100% open rate", "-3.1 average units sold/2.0 trades taken in per 1000 pieces of mail", "Alaya & Co. has a proven method with a dynamic platform that can triple your sales volume over a four day period.", and "-3.6 average units sold per 1000 pieces of mail". Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 1 states, The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Additionally, BBB Code of Advertising Section 34 states, Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data.
On April 20, 2023 BBB called and spoke with the business about the advertising concerns and the business stated they do not want to be called by BBB anymore.
As of April 27, 2023 the business has not responded to BBB's request.
