The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On May 20, 2024, Western Benefits Group, LLC entered into a consent order (case: 2024-CFPB-0003) brought against the company by the Consumer Financial Protection Bureau (CFPB).
The order stems from allegations that Western Benefits Group violated the Telemarketing Sales Rules and the Consumer Financial Protection Act.
According to the consent order, the company is alleged to have charged advance fees for student loan debit relief services, used deceptive sales practices in their marketing of services, and misrepresented that they were associated with the Department of Education.
Consumers were led to believe that services they were paying for would go towards paying off student loans, help with lowering monthly payments or would help with obtaining loan forgiveness.
As part of the order, without admitting or denying any of the findings, Western Benefits Group will cease all operations permanently, null all student-loan debt-relief agreements and cease collecting any fees for student-loan debt-relief agreements. In addition, they will pay a $400,000 civil penalty.
