On September 29, 2022, Russell Hathcock and East Valley Property Management LLC DBA Zen Rent Property Management entered into a Consent Order with the Arizona Department of Real Estate. The Consent Order settles allegations that the business failed to maintain a broker policy and procedure manual in accordance with the law, failed to ensure that all client monies shall be used for the purposes they were deposited for, and failed to keep brokers records in accordance with generally accepted accounting principles, leading to misstatements of assets available in the trust bank account. The Consent Order further settles allegation that Russell Hathcock failed to exercise reasonable supervision over the activities of the salespersons, associate brokers, or others under the broker's employ, or failed to exercise reasonable supervision and control over the activities for which a license is required of a corporation, limited liability company, or partnership on behalf of which the broker acts as a designated broker. Under terms of the Consent Order, the business was ordered to pay a civil penalty of $4,000.
