On May 11, 2023, BBB requested ERCOnly.com to modify, substantiate, or discontinue claims made on their website (https://erconly.com/) that read, "Roughly 95% of the businesses we work with qualify for refunds. And nearly half of those were informed by others that they did not.", "Less than 3% of businesses have filed for the ERC", "It takes teams of specialists. ERC, that is what we do. Over 200 CPAs, Lawyers, Financial Professionals..yeah that's all we do", and "Over 4,000 filings..Not one has been kicked back". Additionally on the company's Facebook (https://www.facebook.com/ERConly) it reads, "Hundreds of carefully vetted tax, accounting and legal professionals working with a sole purpose..". Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 34 states, Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. Additionally, BBB's Code of Advertising Section 1 states, The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
On May 15, 2023, the business emailed BBB stating they would respond in 5 days. BBB emailed back the same day acknowledging the business' email.
