On 16Jun22, I went into contract with ************************* the owner of Piedmont Pools LLC. The contract specified general construction specifications. Per the contract, the construction was to begin on or about July 2022, and work was estimated to be substantially completed in August of 2022. on April 27 2022, we paid by check $5000 for ******* money. On June 16, we paid by check $52,379.50 which was calculated to be 50% of the pool cost and was due at the signing of the contract. On 5 August the hole in the backyard was dug for the fiberglass pool to be installed. I was told that this constitutes the erection of the walls so the 40% was due. On 5 Aug we provided a check for 40% plus we also had a change order for an amount of $9065.50 so the check was written for $50969.10. By 5 August, we had paid Piedmont Pools a total of a $108,348.60 by checks. The total cost of the pool specified in the original contract was $109,759.00. The cost of the change order was $9,065.50. The change order consited of equipment and metarial that was never provided by the pool builder nor was the amount ever refunded. An invoice was provided for equipment and material that was in the original contract but not all the items provided in the invoice were ever provided. Items in original contract include LED lights, concrete, a waterfall feature, unbrella holdrers, electrical work, permits, and labor costs. A $900 spa heater was provided but his invoice shows we were charged $9200 for it. Based on my calculations we were overcharged $30,327,60. We provided the invoice to him to request the overpayment be paid back and even wrote to the ******* ** consumer complaint line and provided the information. We were told by the letter in the ** "Because the individual/company has obviosly indicated an unwillingness to cooperate with this office in its role as mediator, the Attorney General does not have authority to pursue the matter further." I was recommended to seek legal action by the **.

We signed a contract with Piedmont Pools, LLC and ************************* on 6-29-22 to build a pool that would be completed by August 2022. We paid him $46,305 for the deposit. It is now 2-1-23 and no work has been started. After months of excuses including administrative problems, delivery problems and the real kicker was that ******* actually was not a licensed contractor when he entered in the contract with us, so that added to his excuses! ******* told my wife in October 2022 that he could no longer do our project and did not have any of our money to pay us back nor did he use any of our money to pay for the pool shell, equipment and delivery fee. Basically, he cashed our check with no intent of honoring the contract he entered into with us and used the money for his personal use! He has given us every excuse to delay paying us our money back. He stated in November that he was already paying two other customers back and would be done paying them in December 2022. We have attempted to have him sign a promissory note for three or four payments to pay us back the $46,305 he basically stole from us. His latest excuse came on 1-16-23 stating that he would pay for our pool shell, pool equipment and supplies from Superior Pools by 1-27-23. He did not pay Superior Pools any money as he had promised on 1-27-23. His excuse was that we needed to have a delivery date so that the pool shell could be put in the ground. We are not having a hole dug in our backyard, which would be an OSHA violation while we wait for ******* to actually pay for our pool! Again, another excuse! The latest excuse is that he is broke and can't pay us all of our money back in one check. We have offered to set up a payment plan and he refuses to communicate with us. This has been going on for seven months. We want our money refunded ASAP. We moved from another state due to the increased crime. We never guessed moving to ******* we would become crime victims in our own backyard. We give this company an F!!!!
