They are refusing to return my $1000 that I put down to make my loan lower. There was never a deposit or down payment needed. The windows were never ordered. The revised quote was never signed. They tried to turn the free estimate into a $350 estimate but if I decide to buy windows from them, they will credit me $350. They even tried to say cancelation has to be within 72hrs. After I stated that I told the guy that measured the windows not even 24 hours later, not to submit the measurements, and he confirmed he wouldn't until I sorted out my concerns with the salesman and that conversation was via texts. The salesman then told me he would share this with the accounting department. I also asked him how any windows were ordered when he kept texting me, calling, etc, asking what he could do to help me finalize the order? 21 days and I have yet to be returned my $1000. It was 10 days ago when he said he would relay the new info to the accounting department and not a word since. He didnt even respond to my text today. I told him if needed, I will take them to small claims.

The situation with the customer goes back to October of 2023. Customer first contacted us and asked if we could come out and  give him an estimate for 3 Windows. An estimate was sent to the customer on 10/05/2023. In early July of 2024, Customer asked if we could come back to his home and offer up an estimate for windows again. At this time we went through many different configurations of windows, colors and finishes. On July 8th, a new estimate was sent out to the customer, After several exchanges of texts, emails, voice messages and calls, numerous revised estimates went out to the customer, but on July 17th the contract was signed for 5 Windows and 6 Wraps, the customer was already approved for Financing.. The customer wanted to put down a $1000 deposit for the financing even after being advised by the sales rep to keep his deposit until the financing was being processed. Once all the paperwork was completed, we went out on Wednesday July 24th. We met up with the customer at his employment and collected the $1000
On July 25th, our Installation Manager went out to do an Official Measure before all the windows were ordered. After the Official Measurement with my Installation Manager I was informed that the customer would like to discuss some changes. On Monday July 29th at 12:42PM, we contacted the customer via text to find out the changes. This was continuous in changes until Saturday August 12 when we received a text about trying to see what his Insurance would say about the windows, at this time we told the customer that due to all of his changes to the current contract that we would put a hold on the new REVISED estimate. From August 12 thru September  20th, The customer asked for several changes and "what ifs" and even wanted to look at a different line of windows. On October 1st, we were sent a text that said that he was going to hold off on the windows for now due to his job not being secure and not wanting another monthly payment on his plate, at this time he asked for his deposit back.

This situation has never happened to us before as far as a return of a deposit and our process for payments on return is a 60-90 day return policy.

After this request had happened, we received multiple texts( October 9th, October 11th and October 21st ) to return the deposit which were demands of payment and threats to go to the BBB and Small Claims. This was all after we told him that we would share all this information with our accounting department.

They have basically admitted that no windows were ordered. They advertise free estimates but tried to charge me $350 for estimates/measurements. I never signed any agreement that I would be charged $350 for estimate or measurements. I was first told by their sales rep via texts that they were getting my check mailed out to me on Oct 9th 2024. On Oct 11th 2024 the sales rep told me via texts that they were now charging me with cost associated with the order, such as official measurement, processing fee and a cancellation fee. None of that was signed in an agreement or told to me prior. He even said in the same text that in any type of contract I have 72 hours to cancel. The order was canceled the next day when I told the measuring guy not to send the order in and as they stated nothing was never finalized after that. They said in their response that there is a 60-90 return policy but their sales rep stated in the same text on Oct 11th 2024 that accounting were going to to cut my check for $650 that day. So another lie about the 60-90 day return policy. This is just retaliation because I decided not to do business with them and wasn't stupid enough to let them rob me of $350. They have refused to respond to my text and emails since Oct 11th 2024. I will keep demanding my money until I receive it from these thieves. What they didn't mention is that I advised them that if my money isn't returned by this coming Monday Nov 4th 2024 , I will file my small claims against them
