Colorado Insurance Commissioner Final Order
On April 1, 2022, the business entered into a Final Agency Order with the Colorado Division of Insurance. The Order settles allegations that the business failed to pay provider claims per Colorado law, failed to communicate with insured consumers, did not process consumer payments and accounts and untimely processing of claims (violations of sections 10-16-106.5(4)(a), 10-3-1104(h)(II), 10-16-104 (5.5)(a)(I)B) and 10-3-1104(h)(V) of the Colorado Insurance laws). Under terms of the Order, the business agreed to come into full compliance with the Nov. 2021 Improvement plan by processing and paying all outstanding claims by April, 2022; and implement metrics to show improved responsiveness to consumers by July 30,2022. The business also agreed to pay a civil penalty of $750,000.00 for violations in 2021; a civil penalty of $250,000.00 for violations in 2022.
