AG Nessel Sues Tree Service Companies for Price Gouging, Other Consumer Protection Act Violations Following Severe Weather
The following
describes a pending government action that has been formally brought by a
government agency but has not yet been resolved. We are providing a summary of
the government’s allegations, which have not yet been proven.
On June 3, 2024,
the Michigan Attorney General filed a complaint in 30th Circuit
Court in Ingham County. The Attorney General alleges the business is in
violation of state law and the Michigan Consumer Protection Act.
According to the
complaint, Holtslander and Sons and other companies named in the complaint including
E & B Contracting based in Kentucky, targeted consumers who suffered tree
damage during a storm. As alleged, the business misled consumers about the
nature of the agreements they were signing, the cost of the services, potential
financial responsibility for costs not covered by insurance, and their legal
rights and obligations.
