In April 2022, Better Business Bureau questioned Kunes Country Honda's marketing piece, which stated:
“100% GUARANTEED FINANCING AVAILABLE!”
“NEED A VEHICLE BUT HAVE CREDIT ISSUES? 100% GUARANTEED FINANCING AVAILABLE!”
“A WINNER FOR EVERY PRIZE HAS BEEN MAILED IN YOUR AREA, BUT YOU HAVE TO COME IN TO WIN!”
“IF YOUR SYMBOLS MATCH, YOU’RE A WINNER! GO ONLINE TO PICK THE GRAND PRIZE YOU WANT.”According to Better Business Bureau’s Code of Advertising, “The words ‘no credit rejected,’ ‘guaranteed financing,’ ‘all credit applications accepted’ or words of similar import can imply that consumer credit will be extended to anyone regardless of the consumer’s credit worthiness or financial ability to pay. They must only be used when all credit requests are approved.”
In addition the BBB Code of Advertising states, “The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact. In addition, according to the Missouri state statute 15 CSR 60-7.020 (1): “A seller shall not make a representation or statement of fact in an advertisement that is false or has the capacity to mislead prospective purchasers.
BBB requested the business to substantiate, modify or discontinue any similar future advertising. The company initially responded but did not respond to BBB’s additional request for clarification regarding the grand prize, layout of the piece and credit approval.
