Georgia Nonpublic Postsecondary Education Commission v. Medical Career Specialist, Inc, Medical Career Specialist, Erudite Nursing Institute, and Melody Knight, individually and dba Erudite Nursing Institute
On March 2, 2021, the Georgia Nonpublic Postsecondary Education Commission (GNPEC) filed a Civil Action in the Superior Court of Cobb County, GA against Medical Career Specialists, Inc., dba Erudite Nursing Institute. Charges filed allege the business is in violation of O.C.G.A. Sections 43-26-10(7) and 43-26-42(7), which dictate that the Georgia Board of Nursing (the Board) must approve any entity conducting a nursing education program that prepares persons to practice nursing as registered professional nurses or licensed practical nurses. This matter is pending.
In June 2024, Erudite Nursing Institute notified BBB that they are disputing GNPEC’s allegations. The company provided the following information about their position in the matter:
"We would like to emphasize that the GNPEC's claims are frivolous. As you can see at the following link, subject to certain special limitations, "nontraditional" students are eligible for NCLEX/Board licensure in Georgia: https://rules.sos.state.ga.us/GAC/410-2-.02. For example, Erudite students must test for Board license within 90 days instead of the standard 3-year time period allotted to "traditional" schools. We do not conduct "nursing education programs" as defined under O.C.G.A 43-26-10(7) and O.C.G.A. 43-26-42(7) and have not violated either of those Code sections/statutes."

On December 19, 2024, Erudite Nursing Institute supplied BBB with the following information:
“All Erudite Nursing Institute graduates are eligible for NCLEX/Boards licensing as "non-traditional students" in every U.S. State and Canada. Erudite Nursing Institute is nationally accredited by the National Healthcare Credentialing Institute (NHCI) under the Federal Board of Medical Services (FBMS) and meets or exceeds the standards of Title 34 of the Code of Federal Regulations, Part 62, Subpart A, Section 602.1(A); 20 U.S.C. 1099b. Despite every false allegation by anyone, including the Georgia Nonpublic Postsecondary Education Commission (GNPEC), pertaining to O.C.G.A. Sections 43-26-10(7) and 43-26-42(7) or otherwise, Erudite is exempt for purposes of Public Law 110-315 and guarantees NCLEX Board eligibility for every qualified graduate. Note: Licensing exams must be registered for within 90-days of graduation to maintain eligibility. Applications that fall without that timeframe are subject to re-certification of eligibility in accordance with the applicable state or federal board policies, without exception.”
