This BBB Business Profile provides information about Private Label Sk.in, NA, LLC and its group of affiliated companies having 100% common ownership (collectively referred to as "PLS"). These include #Fulfillment, Evora Worldwide, EWorld Fulfillment, Hashtag Fulfillment, iShip Solutions, Onoxa, PrivateLabelSupplements.com, Quality Harbor, and World Product Solutions. BBB has been in communication with PLS from 2016 to present, bringing to PLS's attention and discussing BBB's concerns with the company's business practices. In July 2016, BBB contacted PLS about its business practices, as BBB had received significant complaint activity involving a large number of products using addresses owned, operated, and/or affiliated with PLS. According to information in BBB files, these products have had their orders fulfilled and shipped by PLS. Complaint activity and advertising practices are consistent across most of the product lines. BBB files indicate that the product lines have a pattern of complaints concerning unauthorized and/or unexpected charges and unresolved refund disputes. Complaints filed by consumers state that they signed up for what they thought was a free trial of a product and later discovered additional unauthorized and/or unexpected charges to their credit cards for additional amounts. In reviewing the advertising practices of the product lines, BBB has determined that the advertising used for most products makes no disclosure or has inadequate disclosure that customers are signing up for a continuity program. Also, many product lines have used fake celebrity endorsements of the products in the advertising (a list of celebrities used in conjunction with such advertising is provided later in this BBB profile). BBB's experience is that a product line is marketed for a period of time until it generates significant complaint activity, at which time that product line is discontinued. In September 2016, BBB first met with owners and representatives of PLS to discuss these concerns. PLS indicated to BBB that it manufactures and sells cosmetic products to wholesale buyers and provides fulfillment services (i.e. warehouse, pick, pack, and ship) for cosmetic and other products. PLS has stated to BBB that it does not perform any of the following services involving the product lines, and that these functions are performed by PLS's customers: (1) take any retail orders, (2) process retail customer payments, (3) operate customer service departments for retail customers, (4) operate or design retail websites, or (5) assist any wholesale buyers develop retail sales programs. PLS further stated that the complaints detailed in its BBB Business Profile, complaints which customers filed directly against PLS, are misdirected by the consumers filing the complaints. PLS indicated that consumers should be filing their complaints against the retailer that sold the product to them, not PLS as PLS has only fulfilled the order and shipped the product(s) to the consumers. BBB policy allows customers to file a complaint against any business that they have had a marketplace interaction. BBB has received thousands of complaints and negative customer reviews filed against product lines fulfilled and/or manufactured by PLS. BBB requested that PLS provide BBB ownership information for the businesses that own the various product lines that are generating the complaint activity. PLS has declined to provide BBB this information, stating that doing so would violate the contracts it has signed with these businesses to perform its services. Subsequent to our meetings in 2016, PLS began to utilize a large number of different addresses not known previously to BBB. These addresses were used by PLS's customers involving the sale of the customers' product lines. Addresses that BBB has identified as being used by product lines that have had their orders fulfilled and/or manufactured by PLS are provided later in this BBB profile. In 2018, BBB and PLS met and had a number of conference calls to discuss the information detailed in this BBB Business Profile. PLS reiterated that it has no responsibility for actions taken by its customers, online sellers of the product lines. PLS has informed BBB that it has implemented policies geared towards providing transparency to consumers to help alleviate any confusion that they may have about the online sellers involved. For fulfillment services PLS is providing, it is shipping products for customers but is not accepting returns for those products. According to information in BBB files, most product lines fulfilled by PLS no longer are using PLS's addresses within the product websites, packaging, and packing slips that are received with the product packages. On the package itself, there is no information indicating that PLS is the sender. PLS provided BBB examples of a packing slip and a product label that are used in conjunction with products it fulfills and/or manufactures. On the packing slip, there was a phone number and email address for the product, however no business name or address was provided for the retailer should the consumer wish to return the product. On the product label, there was no street address listed for the business name provided. The business name referenced on the label did not have its name registered as a business in the state listed as its location. Throughout 2018, BBB has asked PLS a number of questions in attempts to work with PLS and better understand the business. Working with BBB and answering our questions is voluntary for any business. PLS responded to some questions, but declined to respond to a number of key questions. The responses and information that PLS did provide do not alleviate BBB's concerns with PLS. BBB's rating for PLS reflects BBB's concerns with the business's practices. According to information in BBB files, PLS appears to be a hub for problematic online sellers to conduct business. PLS has knowledge that it has, as customers, many online sellers that are using deceptive practices to enroll consumers into continuity programs. PLS chooses to continue to do business with these customers, profiting off of their financial successes that are born from these deceptive practices. Many of the product lines are using fake celebrity endorsements in their advertising.
