Federal Trade Commission v Razer USA, Ltd

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On April 26, 2024, Razer USA, Ltd entered into a Stipulated Order for Permanent Injunction, Monetary Judgement, Civil Penalty Judgment, and Other Relief with the Federal Trade Commission. The Order settles allegations that the business participated in deceptive acts or practices in the dissemination of false advertisements in or affecting commerce for the purpose of inducing , or which were likely to induce, the purchase of devices. Under terms of the Order, the business was ordered to be banned against COVID-19 prevention or treatment claims in connection with the manufacturing, labeling, advertising, promotion, offering for sale, sale, or distribution of any product, and are permanently restrained and enjoined from making any express or implied representation, whether acting directly or indirectly, in connection with the promoting or offering for sale of Protective Goods and Services, are permanently restrained and enjoined from making any representation, expressly or by implication, about the health benefits, performance, efficacy, safety, or side effects of Protective Goods and Services, unless the representation is non-misleading, including that, at the time such representation is made, Defendants possess competent and reliable scientific evidence substantiating that the representation is true, whether acting directly or indirectly, in connection with the manufacturing, labeling, advertising, promotion, offering for sale, sale, or distribution of any Protective Goods and Services, and are permanently restrained and enjoined from misrepresenting, in any manner, expressly or by implication that any Protective Goods and Services are affiliated with, endorsed, certified, cleared, authorized, approved by, registered, or otherwise connected to any government entity, including through the use of government logos or trademarks, meet certification standards established by any governmental entity when they have not been certified by that governmental entity, the total costs; any material restrictions, limitations, or conditions; or any material aspect of its performance, efficacy, nature, or central Characteristics. In addition, the business was ordered to pay a judgment for civil penalty in the amount of $100,000 and pay a judgment for monetary relief in the amount of $1,071,254.33.

On January, 13, 2025, the Federal Trade Commission is sending more than $1 million to fully refund 6,764 consumers who purchased deceptively marketed Zephyr face masks during the COVID-19 pandemic. Consumers should cash their check within 90 days, as indicated on the check, or redeem their PayPal payment within 30 days. Consumers who have questions about their payment should contact the refund administrator, Simpluris, at 1-833-285-3003 or visit the FTC’s website to view frequently asked questions about the refund process. The Commission never requires people to pay money or provide account information to get a refund.
